Subic Bay Golf and Country Club Clarifies Subic Golf Course Issue

Reacting to a news item written by Ronnel Domingo entitled "Group Set P4.2B to redevelop Subic golf course" which appeared on August 23, 2008 issue of the Philippine Daily Inquirer, Subic Bay Golf and Country Club(SBGCC) thru it's Vice President Mr. Jack Hu clarified that contrary to the article, the issue of the validity of the lease contract of SBGCC thru Universal International Group Development Corporation(UIGDC) with Subic Bay Metropolitan Authority(SBMA)and the forcible takeover by SBMA of the subject golf course is still pending before the Court of Appeal, the case docketed as CA-G.R.SP No. 103084.

Regarding the 2000 case involving the same parties, the truth of the matter is that SBGCC regained possession of the golf course as the Supreme Court made a clear pronouncement that:

"Where it is objected to however a judicial determination of the issue is still necessary SBMA et.al vs. UIG of Taiwan et al. G.R. No.131680 September 14, 2000 340 SCRA 359."

Finally the alleged award of the golf course by SBMA to Hanafil Golf and Tour Inc. is illegal and unautorized, considering the absence of any clear and final judicial pronouncement that the lease contract was validly terminated.
